Luna Rossa Challenge S.r.l. (hereinafter, “Luna Rossa”), with registered office in Via Genova 5/a, Grosseto (Italy), recognises the importance of maintaining the confidentiality, integrity and security of your personal data (hereinafter, the “Personal Data”) and hereby informs you that the Personal Data provided upon accessing the Luna Rossa operating bases or participating in events and regattas relating to and/or connected with the 36th America’s Cup, as well as through the website www.lunarossachallenge.com (hereinafter, the “Site”) shall be processed in respect of the existing European regulations on privacy (Regulation (EU) 2016/679 – hereinafter, the “GDPR”) and the specific local regulations applicable each time to processing carried out outside the European Union.
1. Type and source of the data
Luna Rossa collects and will process Personal Data provided knowingly by your directly through the Site and/or on accessing the operating bases of Luna Rossa or in participating in events and regattas.
The Personal Data processed may include personal details (name and surname, place and date of birth), contact details (address of residence or domicile, email address, telephone number) and number of your ID document.
2. Personal Data of minors
You must be at least 16 years old (or older in accordance with the regulations in your country or state of residence) to provide us with Personal Data. The provision of the data of minors requires the written consent of a parent or legal guardian. If Luna Rossa becomes aware that a minor has provided his/her own Personal Data without the prior written consent of a parent or legal guardian, that data shall be erased or made anonymous. Luna Rossa Challenge does not accept any liability for any untrue declarations provided.
3. Purposes of the processing and legal basis
The Personal Data may be processed for the following purposes:
(a) for registration on the Site and to enable you to access reserved content (e.g. downloading photographs);
(b) for answering and fulfilling any of your requests and, in any event, managing your relationship with Luna Rossa;
(c) for recording and controlling accesses to our operating bases and to events and/or regattas for the purposes of security and protecting the property of the company;
(d) for statistical purposes, in anonymous and aggregate form;
(e) for fulfilling obligations of applicable laws and regulations, as well as ordered imparted by authorities entitled thereto by the law or by supervisory and control bodies.
Moreover, with your prior consent, the Personal Data may be processed for the following purposes:
(f) for sending (by post, telephone, email or any other form of electronic communication or digital methods including social network platforms or other instant messaging apps) by Luna Rossa of informative or promotional communications, including for marketing purposes, newsletters, advertising, catalogues and invites regarding events, initiatives and offers relating to products and services of Luna Rossa and/or third party companies such as sponsors or partners of Luna Rossa;
(g) for the communication of your Personal Data to the Title Sponsors PRADA and PIRELLI for their autonomous direct marketing purposes through email, including the Title Sponsors sending newsletters and other commercial communications relating to products and/or services offered by the companies in the Prada or Pirelli groups.
The processing of the personal data pursuant to points (a) and (b) is necessary to provide the service requested by the data subject. The processing pursuant to points (c) and (d) is necessary for the pursuit of the legitimate interest of the controllers. The processing pursuant to point (e) is necessary to fulfil a legal obligation that the controller is subject to. The processing of the data pursuant to points (f) and (g) is based on prior consent from the data subject.
4. Duration of processing
The Personal Data shall be processed and stored (i) for the time necessary to the execution of the purpose for which the data were collected and, in any event, for a period not exceeding one year following the conclusion of the 36th America’s Cup, (ii) in line with the storage times set out in the applicable regulations, or (iii) until you revoke your consent provided for the processing, where envisaged. Subsequently, the Personal Data shall be automatically deleted or permanently made anonymous.
5. Nature of provision of the data
The provision of the Personal Data is optional.
Nonetheless, if you wish to register on the Site, access the operating bases of Luna Rossa or participate in regattas or events, you must provide the data requested. Otherwise, we may not be able to provide the services requested or permit access to the operating bases, regattas and/or events.
The provision of your Personal Data for the purposes of marketing and communication to third parties pursuant to points (f) and (g) of paragraph 3 is subject to you issuing explicit consent. Should you deny consent, this shall only have the effect of not being able to pursue such purposes, including making it impossible to inform you of initiatives that could interest you and/or send you any other commercial information on the products, initiatives and events of Luna Rossa and/or the Title Sponsors PRADA and PIRELLI.
You may, at any time, change or revoke your consent to the processing of data by writing to the Controller, at the contact addresses indicated in paragraph 9 or using the automated unsubscribe procedures which may be provided to you in our commercial communications or on the Site.
6. Methods of processing
The Personal Data shall be processed using suitable electronic instruments, or, in any event, through automated, IT and electronic instruments, or through manual processing of hard copies, with approaches strictly correlated with the purposes for which the personal data were collected and, in any event, in such a way as to guarantee the security and confidentiality of the data through the adoption of appropriate measures to prevent their alteration, cancellation, destruction, unauthorised access or processing not permitted or not compliance with the purposes of the collection.
7. Recipients and communication of data to third parties
Where necessary and/or useful to the execution of the purposes indicated above, the Personal Data may be communicated to and processed by third parties acting as Processors on behalf of Luna Rossa, with contractual obligations of confidentiality of the personal information, or as autonomous Controllers. Those third parties may belong to the following categories: service providers (for example, providers of security services or IT technicians), advisors and professional firms which we may use for the correct and regular pursuit of the purposes described above, sponsors and commercial partners, legal authorities or police forces.
The Personal Data may be transferred abroad, even temporarily and/or to countries outside the European Union, in compliance with the applicable legislation, adopting all suitable security and guarantee measures for an appropriate level of protection and security of the data.
The Personal Data shall not in any case be disseminated to unknown parties.
8. Your rights
Note that you may exercise the rights envisaged by the applicable privacy regulations (and, specifically, by Articles 15 to 21 of the GDPR), including the right to request information on the existence and characteristics of the processing of your Personal Data, the right to request the rectification and/or erasure, or the restriction of processing, the right to object to processing and/or request the transfer of the Personal Data to another controller, as well as the right to lodge a complaint with the competent control body, including the Italian Data Protection Authority (www.garanteprivacy.it) or to avail of suitable legal venues in the case where you deem that your data was processed in breach of the applicable regulatory provisions.
You also have the right to revoke - at any time and free of charge - the consent to the processing of your Personal Data without harming the lawfulness of the processing based on the consent provided prior to revocation.
